1. Consideration of the following legal questions related to Appeal No. 19-3706,
submitted by Clyde Pinkley of 2063 Springhill Drive, Upper Arlington, Ohio 43221
and Vickie Steiner and Jim Davenport of 3519 Redding Road, Upper Arlington,
Ohio 43221 (collectively, “Appellants”), which was decided, appealed from, and
subsequently remanded to City Council pursuant to the Decision and Final
Judgment in Pinkley, et al. v. Upper Arlington City Council, et al., Franklin County
Common Pleas Case No. 19-CV-10036:
a) By the enactment of Section 3.05(L) of the Unified Development Ordinance
(UDO), did City Council create a “public policy” that all residents of the River Ridge
are intended beneficiaries of Section 3.05(L) of the UDO, thereby granting standing
to all River Ridge residents to challenge approvals of variances from the provisions
of Section 3.05(L) of the UDO.
b) Does Section 3.06(C) of the UDO directly confer standing on Appellants to
challenge the June 17, 2019 Board of Zoning and Planning’s decision (VAR-17-19),
approving the variance request to permit a lot split of two nonconforming lots of
record in combination so that two new homes can be constructed.
